Although it is uncertain if the Supreme Court would take up the issue, TikTok, ByteDance, and another plaintiff in the case are anticipated to appeal to the court.
‘The Supreme Court has a history record of preserving Americans’ right to free expression, and we anticipate them to do the same in this crucial constitutional matter,’ said Michael Hughes, a representative for TikTok.
Sadly, the idea of banning TikTok was founded on false, faulty, and deceptive information, which resulted in the total censoring of the American people, Hughes stated. If this bill is not halted, he claimed, it will “silence the voices of more than 170 million Americans here in the U.S. and around the world on January 19, 2025.”
Even though the case is entirely within the legal system, it’s also possible that former President Donald Trump, who tried to ban TikTok during his first term but later declared during his presidential campaign that he is now against such actions, could provide both companies with some sort of lifeline.
“He wants to save TikTok,” said Michael Waltz, former spokesperson and national security adviser to Trump, during an appearance on Fox Business on Friday.
When President Joe Biden signed the law in April, it marked the end of a long legal battle in Washington, where the short-form video sharing app was considered a national security threat due to its connections with the Chinese government.
The United States has expressed concerns over TikTok’s collection of vast amounts of user data, including private viewing habits, which could potentially be handed over to Chinese authorities. Officials have also warned that Chinese authorities could manipulate the app’s proprietary algorithm, which determines what users see on the app, in ways that are difficult to identify. Similar concerns were raised by the European Union on Friday, as it seeks evidence suggesting that Russia misused the platform to influence Romania’s elections.
